  1. WHAT INFORMATION DO WE COLLECT?

If you are a User of our website, or our potential customer we may collect the following information about you: name, surname, e-mail address, telephone number, IP address and other information provided by you in the “Message” field using the contact form (e.g. company name, position), or in e-mail correspondence sent to us.

If you are our Client, we may collect the following information about you: name, surname, telephone number, e-mail address, company name, registered office address, NIP number, REGON number, bank account number, and others.

If you are a representative of our Client, we collect the following information about you: name, surname, position, telephone number, e-mail address, name of the company you represent and others.

 

  1. FOR WHAT PURPOSE AND ON WHAT BASIS WE PROCESS YOUR DATA?

We process your personal data:

  1. with your consent (provided that it is a valid and effective basis for data processing), to:
  • send you e-mails or text messages containing information about our (and other entities of the group to which we belong) products and services, offers, promotions or events, including in the form of our newsletter;
  1. when it is necessary to perform the obligations imposed on us by the law (art. 6 par. 1 letter c of the GDPR);
  2. when it is necessary for the performance of our legitimate interests (art. 6 par. 1 letter f of the GDPR), when:
  • we contact you and answer your questions, requests, comments and handle your inquiries received through the contact form or by other means;
  • we inform you about our products and services, offers, promotions or special events that we think may be of interest to you;
  • we inform about the products and services of our business partners and other companies of the Adgar Group to which we belong (http://www.adgar.pl/en/adgar-companies);
  • we manage our business, including developing new products and services, conduct consumer and operational research, and evaluate the effectiveness of our sales, marketing, and advertising;
  • we use analytical and profiling tools to: tailor service to your needs (personalisation); adapt the content displayed (including advertising) to your interests and the way you use the online services and the technologies we provide; manage our business; assist in diagnosing technical issues; operate our online services and technologies; identify users of our online services; identify devices to prevent abuse; collect demographic information about our users; and determine how our services are used;
  • we operate, manage and improve products, offers, promotions and online services as well as other technologies;
  • we ensure the security of our networks and systems.

If you are our Client, we process your personal data:

  1. in order to conclude and implement the agreement (art. 6, par. 1, letter b of the GDPR);
  2. when it is necessary for the performance of our legitimate interests (art. 6 par. 1 letter f of the GDPR), when:
  • we contact you within the framework of an existing business relationship,
  • we assert our claims or defend ourselves against the claims of our contractors
  • we handle complaints;
  • we produce summaries, statistics, reports, etc;

 

If you are a representative of our Client, we process your personal data when it is necessary to pursue our legitimate interests (art. 6, par. 1, letter f of the GDR), in order to conclude and perform an agreement with the Client you represent or to handle ongoing correspondence as part of the business relationship between us and the Client you represent.

 

  1. WHO DO WE SHARE YOUR PERSONAL DATA WITH?

Where necessary for the purpose for which we process your data, we may transfer it to:

  1. entities entitled to receive them on the basis of legal regulations (e.g. law enforcement authorities, supervisory authorities, etc.);
  2. entities processing personal information on our behalf as part of their services, such as companies providing consulting, IT, security, PR or marketing services to us;
  3. other entities being a part of the Adgar capital group to which we belong (http://www.adgar.pl/en/adgar-companies).

 

  1. HOW LONG WE STORE YOUR DATA?

We store information about you for the period necessary to fulfill the purposes set forth in this privacy policy and in accordance with our data retention policies (unless a longer period is required by applicable law). Our data retention policies are based on applicable law. We will retain and use information about you to the extent necessary to comply with legal requirements (for example, if we are required to retain information about you for tax purposes), to resolve disputes, to perform a contract, to reach an amicable settlement, or for the purpose set out in this privacy policy.

 

  1. WHAT RIGHTS DO YOU HAVE?

By exercising your rights in relation to the processing of personal data, you may address the following requests to us:

  1. if we process your personal information on the basis of your consent, you may withdraw that consent at any time; however, please note that the withdrawal of consent does not affect the lawfulness of the processing we have carried out on the basis of your consent prior to the withdrawal;
  2. you may request access to and obtain a copy of your personal data;
  3. you may exercise the right to transfer your personal data, i.e. to request that we obtain your data in a structured, commonly used and machine-readable format, and you may also request that we send it directly to another controller if we process it by automated means based on your prior consent;
  4. you may request that your personal data be corrected if it is incorrect or incomplete;
  5. due to your particular situation, you may object to the processing of your personal data if we process it based on our legitimate interest; or you may object to the processing of your data for the purposes of direct marketing;
  6. in cases defined by law - e.g. if your data is obsolete, unnecessary, processed illegally, or if you have withdrawn your consent to its processing (if the consent was the basis for such processing) or if you have effectively objected to the processing of your personal data - you may request that your personal data be deleted;
  7. you may also request that the processing of your data be restricted for as long as we process your objection or a claim regarding the correctness of your personal data, the lawfulness of the processing of your data or our legitimate interest, or if the data is necessary for you to establish, pursue or defend a claim.

Whenever you consider that the GDPR provisions are violated, you also have the right to file a complaint with the President of the Office for Personal Data Protection.

 

  1. DO YOU NEED TO PROVIDE US WITH YOUR DATA?

Submitting your data is completely voluntary, but if you fail to do so, we will not be able to fulfill the purposes mentioned above, in particular to answer your enquiry and to provide you with an offer.

If you are our Client, without your data it will not be possible to conclude and fulfill the contract.

If you are a representative of our Client and do not provide your data, this may prevent us from entering into and performing a contract with the Client you represent or from contacting the Client as part of your existing business relationship.

 

  1. WHERE DO WE GET YOUR DATA FROM?

If you have not provided us with your data, we have received it from the Client you represent or we have downloaded it from public sources.
